Terms & Conditions
The terms on which we accept, carry and deliver your cargo. Please read them before you book – you accept them at the point of payment.
Terms and Conditions of Carriage
Applies to all cargo accepted by Lord Taylor at any branch, in the United Kingdom or Nigeria.
1. Who we are and what these terms cover
These terms govern the contract between you and LordTaylor World, trading as Lord Taylor World, registered in Nigeria and the UK, whose registered office is at Triangle Mall, Shop G33, Lekki-Epe Expressway, Jakande, Lagos (“we”, “us”, “our”).
They apply whenever you ask us to carry, forward or arrange the carriage of cargo, whether you book at one of our branches, on our website, or through a member of our staff. By handing cargo to us and completing payment you accept these terms.
We may act either as a carrier or as a freight forwarder arranging carriage by third parties. [LAWYER: this distinction determines the liability regime and must be settled — see Section D, question 1.]
2. Definitions
Term | Meaning |
Cargo | Any goods you hand to us for carriage, including all packaging |
Branch | Any Lord Taylor receiving centre listed on our website |
Cut-off | The weekly deadline by which cargo must reach a branch to travel on that week’s service |
Chargeable weight | The weight on which your price is calculated — see clause 4 |
Receiver | The person named by you to take delivery of the cargo |
Consignment | A container, pallet or grouped shipment in which your cargo travels with other customers’ goods |
3. Booking and acceptance
A contract is formed only when we have accepted your cargo at a branch and payment has been received in full. Until both have happened, no contract exists and we are under no obligation to carry anything.
We may refuse any cargo, at any branch, without giving a reason. We will always refuse cargo that is prohibited, inadequately packed, incorrectly declared, or that we reasonably believe may endanger other goods, our staff, or the aircraft or vessel.
You confirm that you are the owner of the cargo, or that you are authorised by the owner to enter into this contract on their behalf.
Identification. A valid form of identification is required from any person depositing cargo at our Lagos branches. We may refuse cargo where identification is not produced.
4. Weighing and chargeable weight
Cargo is weighed at the branch, in your presence. The weight recorded at that point is final for the purposes of the contract.
Your chargeable weight is the actual weight recorded plus a pallet allowance applied by band, as published on our rates page and displayed at every branch. A handling fee applies to cargo leaving the United Kingdom.
Where the actual weight of cargo is later found to exceed the weight declared or recorded, we may require payment of the difference before the cargo is released or dispatched. Where the corrected weight is lower, we will refund the difference in accordance with the Refund Policy.
5. Prices, currency and payment
Prices are those published on our website and displayed at our branches at the time of booking. We may change published rates at any time, but a change will never affect a booking already paid for.
Cargo booked in the United Kingdom is priced and payable in pounds sterling. Cargo booked in Nigeria is priced and payable in Naira.
Payment is required in full before dispatch. We do not carry cargo on credit unless a written business account agreement is in place.
Additional charges may apply where cargo requires crating, special handling, or falls into a category priced on inspection. Where such a charge applies, we will tell you the amount before you pay, and it will appear as a separate line on your invoice.
6. Prohibited and restricted items
You must not include in your cargo any item listed as prohibited on our website, or any item whose carriage, export or import is unlawful in the United Kingdom, Nigeria, or any country through which the cargo passes.
Any perishable goods or prohibited items that we accept are carried entirely at the owner’s risk. We accept no responsibility for damage to such goods, or for goods seized, detained or destroyed by any customs or border authority.
Where prohibited items are found in your cargo we may, without liability to you: refuse or remove them; hand them to the relevant authority; and recover from you any fine, penalty, storage charge or cost incurred as a result. You remain liable for the full carriage charge.
Food and protein. Protein items are accepted only where thoroughly dried. Cargo that is not adequately dried may be refused, and we accept no liability for spoilage or for damage caused to other goods in the same consignment.
7. Packing and your responsibilities
You are responsible for packing your cargo so that it withstands ordinary handling in transit, including stacking, vibration and changes in temperature and pressure. We are not liable for damage arising from inadequate packing.
Fragile items require crating. Where you decline crating that we recommend, the cargo is carried at your risk.
You must give us accurate and complete information, including a correct description of the contents and full contact details for the receiver. We are not liable for delay, misdelivery or non-delivery caused by information you have given us that is incorrect or incomplete.
8. Photographs and records
We photograph cargo at the point of acceptance. These photographs form part of our record of the condition and contents of the cargo and may be used in handling a claim. They are held in accordance with our Privacy Policy.
9. Cut-off times, schedules and transit estimates
We operate scheduled weekly services. Cargo that reaches a branch after that branch’s published cut-off will travel on the next available service.
All transit times quoted are estimates, not guarantees. Air freight is normally 5–7 working days and sea freight normally 5–7 weeks, but neither is a contractual commitment.
We are not liable for delay caused by weather, airline or shipping line schedules, port or airport congestion, customs inspection, industrial action, civil unrest, or any other cause beyond our reasonable control.
10. Customs, duties and inspection
Cargo is subject to inspection by customs authorities in both countries. We are obliged to co-operate with, and provide information to, those authorities.
You are responsible for any duty, tax, levy, fine or charge imposed on the cargo. Where we pay any such amount in order to release the cargo, you must reimburse us on demand.
We are not liable for loss arising from customs inspection, detention, seizure or destruction of cargo.
11. Delivery, collection and unclaimed cargo
Unless door-to-door delivery has been booked and paid for, cargo must be collected from the destination branch by the receiver, who must produce identification.
We will notify the receiver, using the contact details you provide, when the cargo is available for collection.
Where cargo remains uncollected for more than [NUMBER] days after we notify the receiver, we may charge storage at [RATE] per day. Where cargo remains uncollected for more than 7 days, we may dispose of it, and apply any proceeds against sums owed to us. [LAWYER: notice periods and disposal rights need review — Section D, question 6.]
12. Our liability
Subject to the paragraph below, our liability for loss of or damage to cargo is limited to [CAP] per shipment, or [CAP] per kilogram of the affected cargo, whichever is the lower.
We are not liable for indirect or consequential loss, loss of profit, loss of market, or loss arising from delay, in any circumstances.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited or excluded. Where you deal with us as a consumer, your statutory rights are unaffected.
13. Claims
Any claim for loss or damage must be notified to us in writing within 5 days of the date the cargo was delivered, or, where cargo has not been delivered, within [NUMBER] days of the date it should reasonably have been delivered.
Claims must be supported by your invoice, the tracking reference, and evidence of the value of the goods. We may require the cargo and its packaging to be made available for inspection.
We will acknowledge a claim within 7 working days and give a decision within 10 working days of receiving all information we reasonably require.
14. Additional cover
[LAWYER: if Lord Taylor offers or arranges any form of cargo cover or insurance, this may be a regulated activity in the United Kingdom requiring FCA authorisation or an exemption. See Section D, question 7. Until that is resolved, no cover should be offered.]
15. Cancellation and refunds
Cancellations and refunds are governed by our Refund Policy, which forms part of these terms.
16. Data protection
We handle personal data in accordance with our Privacy Policy, which forms part of these terms.
17. Changes to these terms
We may change these terms from time to time. The version that applies to your booking is the version published on our website at the time you paid. We record which version you accepted.
18. Governing law and jurisdiction
[LAWYER: this must be settled and may need to differ depending on where the contract is formed. See Section D, question 4.] These terms and any dispute arising out of them are governed by the law of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction.
